Terms of Service
fileustaxes.com
File U.S. Taxes LLC ("File US Taxes," "we," "us," "our"), a Wyoming limited liability company foreign-registered in Florida. These Terms of Service ("Terms") govern your use of fileustaxes.com, our client portal landing pages, our social media and chat channels (including "Ask Tiny"), and our referral program, together "the Site." By using the Site, you agree to these Terms. If you become a client, your actual tax preparation services are governed by the separate Engagement Letter you sign, not these Terms; where the two conflict as to preparation of your tax return, the Engagement Letter controls.
1. Who we are and what the Site is for
File U.S. Taxes LLC is a tax preparation firm. The Site lets visitors learn about our services and pricing, chat with our automated assistant "Tiny," book a consultation or filing slot, join our optional referral program, and access general tax information content. The Site is informational and promotional; tax preparation itself happens in our secure client portal after you sign an Engagement Letter.
2. Eligibility and acceptable use
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account, join the referral program, or engage us for services. You agree not to misuse the Site โ attempt to access another client's data, probe or disrupt our systems, scrape content at scale, submit false information, use the Site unlawfully, impersonate another person, or attempt to manipulate the referral program (for example, self-referrals, which are automatically blocked and never paid). We may suspend or terminate access to the Site or referral program for violation of these Terms, fraud, or abuse, and may decline to engage any visitor as a client for any lawful reason.
3. Tiny: automated assistant disclosure
Tiny is our animated "Tax Guide" and the public face and voice of the firm across the Site, social media, and chat. Tiny is an automated assistant, not a person. Every chat conversation discloses this. Tiny provides general tax information; Tiny does not give individualized advice about your specific return, and nothing Tiny says creates an engagement or professional relationship with us. If you want a real, credentialed preparer, Tiny will connect you with one. Content on the Site, including anything Tiny says, does not constitute legal, tax, or financial advice for your specific situation absent a signed Engagement Letter.
4. No guarantee of tax outcomes
Nothing on the Site โ including pricing pages, Tiny's answers, blog content, videos, testimonials, or marketing claims โ is a promise or guarantee of any specific tax outcome, including refund size, refund timing, or audit result. Statements about our process describe our methodology, not a guaranteed result. We do not claim affiliation with or endorsement by the IRS, and we never use IRS branding to suggest otherwise.
5. Pricing, referral program, and tips
Published prices on the Site, once available, will reflect our current published price schedule, which may change between seasons; the price that applies to your actual engagement is the one confirmed at booking and in your Engagement Letter. Our referral program (described on the Referral Program page) is open to anyone, whether or not you are a client, and is governed by its own published terms, incorporated here by reference; rewards are paid only for genuine new clients, and self-referrals are never paid. "Tips" to Tiny, if offered, are voluntary payments for helpful content, are not charitable donations, and are not tax-deductible, and are not associated with or a condition of any client's engagement.
6. Cookies, analytics, and data handling
Use of the Site is subject to our Privacy Policy, which explains cookies and analytics tracking, the separation between the public Site/marketing systems and our secure client system ("the Vault," operated on Amazon Web Services), and your choices. By using the Site you consent to the data practices described there, subject to your cookie-consent choices.
7. Intellectual property
All Site content โ including the Tiny character, videos, text, graphics, logos, and the "File US Taxes" name and marks โ is owned by File U.S. Taxes LLC or its licensors and may not be copied, modified, or used commercially without our written permission. You may share links to our content and use it for personal, non-commercial reference.
8. Third-party links and partners
The Site may link to or reference third parties: state-return partner firms, payment processors, and similar. We are not responsible for the content, services, privacy practices, or outcomes of third parties; any engagement with a partner firm is governed by your separate agreement with that firm.
9. Disclaimers and limitation of liability
The Site and its content are provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law. To the maximum extent permitted by law, File U.S. Taxes LLC is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site, reliance on general content or Tiny's answers, or any third-party service linked from the Site. This section does not limit liability that cannot lawfully be limited, and does not apply to the separate liability terms in your signed Engagement Letter governing actual tax preparation services, which control for that engagement.
10. Dispute resolution
Informal resolution first. Before filing any claim, you agree to contact us at [email protected]and give us 30 days to resolve the issue informally. Arbitration and governing law provisions are still being finalized with counsel and will be published here before this Policy takes effect; in general, we expect disputes that can't be resolved informally to go to binding individual arbitration rather than court (except for small claims court or injunctive relief for IP or system misuse), on an individual basis without class actions, under Florida law without prejudice to applicable federal law (including Circular 230 and IRC ยง7216).
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on the Site, and, for active clients, will not change the terms of an already-signed Engagement Letter for a return in progress.
